A contractor in the Abai Region has been ordered to pay more than 12 million tenge in penalties for missing deadlines on a regional road repair, according to infohub.kz.
According to the official Telegram channel of the Abai Region courts, the Ayagoz District Court heard a civil case brought by the Ayagoz District Department of Housing and Utilities, Passenger Transport, Highways and Housing Inspection seeking to recover penalties.
A contract was signed between the state institution and the contractor for routine pothole repair of the Aktogai — Peresheek regional road.
The contractor was obligated to complete the work by October 30, 2025. The total contract value was nearly 369.5 million tenge. At the same time, only 50 million tenge was disbursed for the volume of work completed.
The court found that the contractor failed to complete the work and did not hand it over to the customer under an acceptance certificate, thereby violating the terms of the contract. The state institution filed a lawsuit seeking penalties of just over 12 million tenge, calculated for the period of delay from October 31 to December 8, 2025, based on the amount of unfulfilled obligations and the terms of the contract.
The defendant argued that the deadline for fulfilling obligations had been extended by an additional agreement posted on the government procurement web portal. The court noted that the document cited by the contractor was not signed by the parties and was merely created on the government procurement web portal. Consequently, such a document cannot alter the terms of the existing contract, including the deadlines for fulfilling obligations.
The Ayagoz District Court ruled in favor of the plaintiff in full. The limited liability partnership was ordered to pay penalties of more than 12 million tenge and a state duty to the state budget.
The court's decision has entered into legal force.
