The Zharma District Court in the Abai Region has heard a criminal case against two defendants accused of attempting to steal property belonging to an organization as part of a group acting in prior conspiracy — the defendants were released from criminal liability, infohub.kz reports.
According to the official Telegram channel of the Abai Region courts, case materials showed that the defendants attempted to illegally take possession of 3,700 liters of diesel fuel belonging to an organization. However, their actions were stopped by security service officers, preventing them from carrying out their criminal intent.
The defendants' actions were classified as attempted embezzlement or misappropriation of entrusted property. During the main court hearing, the injured party and the men announced a reconciliation, stating that the damage had been fully compensated, and asked for the criminal case to be terminated through mediation.
After reviewing the case materials, the court took into account the guilty plea, full compensation of the damage, reconciliation with the injured party, and the conclusion of a mediation agreement.
Given these circumstances, the court concluded that there were legal grounds for applying Part 1 of Article 68 of the Criminal Code of the Republic of Kazakhstan.
By court order, the criminal case against the defendants was terminated due to reconciliation of the parties, and they were released from criminal liability.
The court also issued a corresponding decision regarding the material evidence in the case.
In addition, the civil claim filed by the injured party was terminated due to the reconciliation of the parties. The court order has not yet entered into legal force.
