An individual entrepreneur in Aktau has been held administratively liable for selling counterfeit toothpaste, with the total fine amounting to 90,825 tenge, according to infohub.kz.
According to the official Telegram channel of the courts of the Mangystau Region, the specialized administrative offenses court of Aktau heard a case against an individual entrepreneur under Article 158 of the Code of the Republic of Kazakhstan on Administrative Offenses — "Unlawful use of another's trademark, service mark, geographical indication and appellation of origin of goods."
The court established that on September 30, 2026, employees of the Department of Justice of the Mangystau Region, during an unscheduled inspection carried out on the basis of a citizen's complaint, uncovered the unlawful sale of counterfeit toothpaste by the individual entrepreneur.
At the court hearing, the offender admitted guilt and asked for a milder penalty.
The entrepreneur's guilt is confirmed by the administrative offense report, an explanation, the inspection report, material evidence and other documents.
When imposing the penalty, the court took into account mitigating circumstances — admission of guilt and the fact that the administrative offense was committed for the first time; no aggravating circumstances were established in the case.
Accordingly, the fine of 30 monthly calculation indices (129,750 tenge) was reduced by 30%, and the entrepreneur was ultimately fined 90,825 tenge, with confiscation of the material evidence.
The court's ruling has not entered into legal force.
