A resident of Aktau has won partial compensation from a dental clinic that installed three implants during treatment that were not part of his treatment plan. The total award amounted to 398,829 tenge, according to infohub.kz.

The case began after dental treatment under general inhalation anesthesia. The man said he had gone to the clinic for treatment of cavities and pulpitis, but after the procedure discovered that three implants had been placed. The clinic, for its part, insisted the placement had been agreed with the patient in advance.

According to the ruling of Court No. 2, in November 2025 the man signed a service agreement with the dental clinic. The treatment plan listed treatment of deep cavities in several teeth and treatment of pulpitis under general inhalation anesthesia. Implant placement was not provided for in the contract.

During the operation, which was performed by a general dentist, it was continued by an orthopedic dentist and implantologist. As a result, three implants were placed in the patient. Neither side disputed the fact that the implants were installed.

"The court established that no separate contract for the provision of medical services for the placement of these three implants had been concluded. For the provision of paid medical services, the conclusion of a contract is a mandatory condition. Representatives of the clinic argued that there had been an oral agreement between the doctors and the patient regarding the placement of the implants. The defendant also pointed to WhatsApp messages. However, the court did not accept these arguments. The court did not consider the doctors' testimony about the existence of an agreement sufficient, and, according to the ruling, the WhatsApp correspondence could not establish that the parties had reached agreement on all essential terms of the contract," the publication said.

It is noted that the implants were later removed. According to the medical record of the regional dental center, on December 17, 2025, the patient had the implants removed and was prescribed treatment including antibiotics and other medications. That same day, the man spent 7,277 tenge on medicines.

"The court recognized this amount as material damage and ordered it to be recovered from the clinic. He also sought 5 million tenge in compensation for moral harm. The court granted this claim in part and set compensation at 350,000 tenge. The patient also asked for 1.296 million tenge for the future placement of implants and crowns to replace the removed ones. The court refused this part, since the expenses were hypothetical and had not actually been incurred at the time the case was considered," the outlet added.

In the end, the court ordered the dental clinic to pay him: 7,277 tenge in material damage, 350,000 tenge in compensation for moral harm, and 41,552 tenge in legal costs. The total award amounted to 398,829 tenge. The court rejected the rest of the claim.
