In the Almaty Region, a judicial panel for civil cases overturned a first-instance refusal and granted a secondary school teacher's application to apply the solvency restoration procedure, infohub.kz reports.
According to the official Telegram channel of the Almaty Region courts, the panel reviewed the applicant's appeal against the first-instance court's decision. The woman told the court that her total debt to banks and microcredit organizations exceeds 7.7 million tenge, and due to her financial situation she cannot fulfill her obligations as before.
The first-instance court refused the application, citing the applicant's stable income and ability to meet her obligations to creditors. The judicial panel, after examining the civil case materials and assessing the arguments of the appeal, concluded that the first-instance court's findings did not correspond to the actual circumstances of the case.
The panel took into account the applicant's place of work and the nature of her activity: she works as a teacher at a secondary school and is therefore limited in her ability to earn additional income outside her main job. Her salary is 150,000 tenge.
It was also established that the applicant has three minor children in her care, whom she is raising alone; her husband died many years ago. Her actions are not aimed at concealing assets from creditors or evading fulfillment of obligations. On the contrary, she is a debtor intent on resolving her financial situation through the procedure provided by law.
By the judicial panel's ruling, the first-instance court's decision was overturned and a new decision was issued granting the application.
