Almaty resident wins 250,000 tenge for tree falling on car

A resident of Almaty spent nearly a year seeking compensation after a tree fell on his Toyota Corolla. In the end, he won the court dispute and received a payout of 250,000 tenge, reports infohub.kz.

The car owner shared his story on Threads, along with advice that could help other drivers.

According to the author, after the tree fell, he initially won the case in the district court, but then lost it in the city court. Both sides were preparing to appeal to the Supreme Court when the organization responsible for the tree decided to settle the dispute and voluntarily paid the compensation.

The author admits the process took nearly a year because he had to navigate the legal intricacies himself. Nevertheless, he advises not to give up, even if the damage seems small.

In the comments, users noted they had faced similar situations. One of them said that after a rotten tree fell on his car, he also spent nearly a year seeking payment through the courts.

According to the author, it is important to document everything immediately after the incident. He recommends: calling the police at 102; filming the scene before and after officers arrive; writing a statement and obtaining a certificate; finding out which organization is responsible for the tree; conducting an independent damage assessment if the car is not insured under CASCO; gathering documents, including weather data from Kazhydromet for the day of the incident; sending a pre-trial claim to the responsible organizations; and if refused, going to court.

It was this sequence of actions that helped the owner of the damaged Toyota get compensation.

However, each situation is unique, and the outcome of a court case depends on the specific circumstances and evidence gathered. But this story shows that even after initial refusals, a driver can obtain compensation if they persistently assert their rights.
