A resident of Almaty has won a court case against a negligent contractor who took money for renovation but did shoddy work and failed to complete it. The case was heard in the Moyynkum District Court of Zhambyl Region, where the apartment owner filed a lawsuit against the individual entrepreneur. In October 2025, a contract for renovation works in an apartment in Almaty was signed between the client and the contractor. The total cost of the project was 6.2 million tenge. The client paid the contractor 4.7 million tenge for the first three stages of work, but the renovation dragged on and remained unfinished. The quality of the work performed and materials used did not meet the contract terms.
The individual entrepreneur ignored repeated demands to fix the defective work. Eventually, the homeowner blocked the renovators' access to the apartment and filed a lawsuit seeking contract termination and refund of the money paid.
In court, the defendant did not admit the claim, stating that part of the renovation had been completed, but the project could not be finished because the client stopped allowing access to the premises. However, a court-ordered expert examination showed that the actual value of the work performed and materials used was 1.4 million tenge. Additionally, experts estimated the cost of dismantling and completely replacing the damaged tiles in all rooms of the apartment at 760,000 tenge.
The court concluded that the individual entrepreneur had committed significant violations of the contract terms, depriving the client of what she had expected in return for her payment. The court's decision officially terminated the construction contract and ordered the defendant to pay the plaintiff 3.9 million tenge in principal, plus 385,000 tenge to cover notary, representation, and expert examination costs.
As of now, the court decision has not yet entered into legal force and may be appealed.
