An Astana airport has been ordered to reinstate a department head who was unlawfully dismissed and to pay her about 7 million tenge in compensation for six months of forced absence from work, under a ruling by an appellate court, the website infohub.kz reports.
According to the official Telegram channel of Astana's courts, the civil cases judicial panel overturned a ruling issued on July 16, 2026 by the Astana inter-district civil court in a lawsuit filed by the former employee against Nursultan Nazarbayev International Airport. The plaintiff had sought reinstatement to her previous position and payment of wages for the period of forced absence.
During the proceedings, the court found that instead of her previous post as head of the document management department, the woman was offered a specialist position in a different unit. In effect, this amounted to a change in her job function and a transfer to other work. The employer did not obtain the employee's consent to the transfer and unreasonably treated her refusal of the offered vacancy as a refusal to continue the employment relationship.
The court also drew attention to the timing of document approvals. The job description for the new unit was approved after the plaintiff's dismissal — on April 9, 2026 — whereas her employment contract had been terminated on April 6, 2026. The employer failed to prove any lawful grounds for terminating the contract.
The first-instance court's ruling rejecting the claims was overturned. The appellate court issued a new decision: the claim was upheld, the order terminating the employment contract was declared unlawful and annulled, the plaintiff was reinstated to her previous position as head of the document management department, and the defendant was ordered to pay her wages for six months of forced absence — about 7 million tenge.
The court ruling has entered into legal force.
