Astana Court Partially Grants Bishimbayev's Mother's Lawsuit Against Nazym Kakharman

The Specialized Interdistrict Economic Court of Astana has ruled on a lawsuit filed by Al'mira Nurlybekova — the mother of Kuandyk Bishimbayev, who was convicted of murdering Saltanat Nukenova — against his ex-wife Nazym Kakharman. The claim sought more than 14 million tenge, according to infohub.kz.

According to case materials, individual entrepreneur Nurlybekova owns a premises that on November 1, 2023, she transferred to the defendant — IE NazKa, owned by Nazym Kakharman — under a trust management agreement valid until October 31, 2029.

"The plaintiff stated that the defendant received income from leasing the plaintiff's property but did not transfer the funds received from the use of the premises to the plaintiff and did not provide a full report with supporting documents, which constitutes improper performance of the trustee's obligations," the case materials say.

Nurlybekova ultimately demanded through court that IE NazKa pay 14,074,771 tenge for improper performance of contractual obligations, as well as reimburse the paid state duty and legal representation costs. The defendant, in turn, asked that the claim be dismissed in full, considering the claimed amount and grounds for its recovery unfounded.

In resolving the dispute, the court agreed with the plaintiff's arguments only in part, finding insufficient and reliable evidence of the defendant's debt to the plaintiff. For this reason, part of the sum — 5,839,380 tenge — is not subject to satisfaction, the decision states.

"The claim of IE 'Nurlybekova Al'mira Baltabaevna' against IE 'NazKa' for recovery of the sum shall be satisfied in part. To recover from IE 'NazKa' in favor of IE 'Nurlybekova Al'mira Baltabaevna' the sum of 6,665,391 tenge, state duty of 66,654 tenge, and legal representation costs of 666,539 tenge. To deny the claim of IE 'Nurlybekova Al'mira Baltabaevna' against IE 'NazKa' for recovery of the sum of 7,409,380 tenge," the court decision says.

An appeal may be filed against the decision.

Earlier, Nazym Kakharman, the ex-wife of Kuandyk Bishimbayev, who was convicted of murdering Saltanat Nukenova, stated that his mother had sued her. At that time, she said the claim amount was around 25 million tenge.
