An Astana court has changed the administrative penalty for a woman who live-streamed on TikTok from an entertainment venue while using laughing gas and swearing, replacing administrative arrest with a fine, according to infohub.kz.

The Specialized Interdistrict Administrative Offenses Court of Astana said it considered a case of repeat petty hooliganism against the woman under Part 2 of Article 434 of the Code of Administrative Offenses.

"On September 13 at around 07:00, A., while at an entertainment venue, a public place, behaved rudely and provocatively, demonstratively exhaled the contents of a balloon, and used obscene language, thereby showing clear disrespect for others and disturbing public order and the peace of citizens," the court said.

The court noted that the woman had previously been held administratively liable under Part 1 of Article 434 of the Administrative Offenses Code. The offense was committed within a year after the administrative penalty was imposed.

"At the court hearing, A. admitted guilt and explained that she had consumed an alcoholic beverage, bought a gas-filled balloon at the venue, and went live on TikTok without thinking about the consequences of her actions," the court added.

When imposing the administrative penalty, the court established that the woman is raising a child under 14 on her own. Under current legislation, administrative arrest is not applied to women with children under 14.

"Due to the fact that the penalty under Part 2 of Article 434 of the Administrative Offenses Code in the form of administrative arrest cannot be applied to A., the court reclassified the offense to a provision envisaging a less severe administrative penalty (Part 4 of Article 829-14 of the Administrative Offenses Code). Taking into account the foregoing, A.'s actions were classified under Part 3 of Article 434 of the Administrative Offenses Code, the sanction of which provides for a fine of 20 MCI. By court order, A. was found guilty and subjected to an administrative penalty in the form of a fine of 86,500 tenge," the court said.

The order has not entered into legal force.

It was previously reported that police officers, while monitoring social networks, identified a post involving a girl. During the live stream, she behaved aggressively, disturbed public order, and used obscene language. Police soon identified the 27-year-old native of Almaty Region in connection with the incident.
