A Baikonur resident who was fired after failing to show up for work for two days has won reinstatement to his former position — the dismissal order was overturned following a protest from prosecutors, infohub.kz reports.

According to NUR.KZ, citing the Baikonur complex prosecutor's office, the review was launched after a local resident complained that his labor rights had been violated. Investigators found that the employer had issued an order imposing a disciplinary penalty of dismissal over the two-day absence.

In an official statement on the agency's Telegram channel, officials said that when issuing the order, the head of the organization had failed to request a written explanation from the employee for the absence, contrary to labor law, did not give him two working days to prepare one, and did not draw up a report on the employee's refusal to provide an explanation.

"At the same time, when issuing the said document, contrary to the requirements of labor legislation, the head of the organization, before applying a disciplinary penalty, did not request a written explanation from the employee about the reasons for the absence from work, did not give him 2 working days to provide one, and did not draw up a report on the employee's refusal to give an explanation," the agency said.

To restore the applicant's labor rights, the complex's prosecutor filed a protest against the order. Following review of the response, the order was annulled and the employee was reinstated in his former position.
