A resident of Aktau who runs a blog posted a video of investigative actions on his Instagram page. The footage showed two local residents who were victims in a criminal case. They filed a lawsuit, stating that they had not given consent for the use and distribution of their images, and demanded the removal of the video as well as compensation for moral damages, reports infohub.kz.
During the court hearing, the blogger claimed to be a public figure or freelance journalist, but these arguments were not accepted. The court noted that the published video does not fall under the category of materials for which the consent of the depicted persons is not required.
Ultimately, the court declared the publication of the video illegal, ordered the blogger to delete it from his page, and pay each of the plaintiffs 200,000 tenge in compensation for moral damages. The total amount of payments amounted to 400,000 tenge. The court decision has entered into legal force.
