In Taraz, a two-story trade center built without the necessary permits will be demolished by court order. The individual entrepreneur is required to dismantle the structure at their own expense within a month, as reported by infohub.kz.
The Specialized Interdistrict Economic Court of Zhambyl Region considered a civil case brought by the Department of State Architectural and Construction Control against the entrepreneur. The lawsuit was based on violations found during a scheduled inspection.
It was established that the construction of the trade center was carried out on a plot owned by the entrepreneur, but without an architectural and planning assignment, notification of the start of construction and installation works, design and estimate documentation, and a positive expert conclusion. In addition, the work was carried out without technical and author supervision.
The order issued to the defendant was not complied with within the prescribed period, resulting in the entrepreneur being brought to administrative responsibility. During an on-site court hearing, it also turned out that the building is located within the current red line, and the defendant knew about the change in its boundaries at the time of construction but still began erecting the permanent structure.
The court ordered the entrepreneur to demolish the disputed trade center at their own expense within one month. The decision has entered into legal force.
