A court in Kostanay has ruled in favor of a car owner whose vehicle was damaged by falling snow and ice from a building roof. The court ordered an individual entrepreneur to pay 2 million tenge in damages, reports inbusiness.kz.

According to court findings, the incident took place in March 2026 on Abai Avenue in Kostanay. A mass of snow and ice fell onto the plaintiff's parked car, causing mechanical damage.

The damage amount was confirmed by an independent assessment. Expert reports indicated that the cost of repairs exceeded 1.8 million tenge, and the vehicle’s market value loss amounted to 180,000 tenge.

The defendant requested the lawsuit be dismissed, arguing that warning signs about possible snow and ice falls were placed near the building. However, the court found this unconvincing: the photos presented did not show when the warnings were taken or posted. Moreover, video footage recorded immediately after the incident showed no signs or notices at the time of the ice fall.

In its ruling, the court cited Articles 9 and 917 of the Civil Code of the Republic of Kazakhstan, as well as the Rules for the Improvement of Territories of Cities and Settlements in the Kostanay Region. These regulations oblige building owners to timely clear roofs of snow and ice and ensure the safety of citizens and their property.

The court concluded that the defendant did not take all necessary measures to prevent harm and granted the claim in full. The individual entrepreneur was ordered to pay 2 million tenge in material damages. The ruling has not yet entered into legal force.
