The Military Court of the Akmola Garrison has upheld a female soldier's lawsuit, ruling that the housing commission's decision was unlawful, as reported by infohub.kz.
According to the official Telegram channel of the Military Court, the court considered an administrative case filed by the soldier against the Republican State Institution "Akmola District Operational Unit of the Ministry of Defense of the Republic of Kazakhstan" challenging the housing commission's decision.
The court found that by decision No. 16 of April 9, 2026, the housing commission had refused to recognize the soldier as in need of housing due to her ownership of an apartment in Astana. However, that apartment was purchased with a mortgage loan and is pledged to a bank, and at the time of her application, the loan obligations had not been fulfilled.
After examining the case materials, the court concluded that the housing commission failed to consider the circumstances of the apartment's purchase through mortgage lending and the existence of outstanding obligations to the bank. Consequently, the commission's decision to refuse was declared unlawful and overturned.
The defendant is obliged to issue a favorable administrative act recognizing the plaintiff as in need of housing from the date of registration of her report. The defendant was also ordered to pay the court costs for the state fee. The claims were fully satisfied, and the court's decision has entered into legal force.
