In Kazakhstan, a female doctor who was dismissed for posting a video containing profanity has been reinstated through a court ruling, reports infohub.kz.

The incident occurred at the state institution "Polyclinic" where the woman worked. After videos featuring her using obscene language surfaced on social media, the employer terminated her employment contract. The basis for the dismissal was subparagraph 4-1) of paragraph 1 of Article 52 of the Labor Code, which allows for termination if an employee fails to meet the requirements of their professional activity.

However, the woman contested the decision and filed a lawsuit seeking reinstatement and compensation for wages lost during the forced leave. The courts of first instance and appeal rejected her claim, finding no violations of labor legislation in the dismissal.

Nevertheless, the Cassation Court sided with the plaintiff. It turned out that the employer had not provided evidence, including written proof, that would indicate the employee's non-compliance with professional standards. Moreover, there had been no complaints about her work performance. Consequently, the claim was upheld, and the woman was reinstated in her position.
