In the Karaganda region, a court has released a driver from administrative liability for driving into oncoming traffic, taking into account his care for his disabled mother, reports the website infohub.kz.
According to the official Telegram channel of the Karaganda regional courts, the Bukhar-Zhyrau district court considered an administrative case against a driver under Part 3 of Article 596 of the Code of Administrative Offenses (driving into oncoming traffic).
The court established that on May 4, 2026, the man, driving a VAZ-21110, at the 42nd kilometer of the Karaganda – Ayagoz – Bugaz – Tarbagatai highway, on a section marked with a "No Overtaking" sign, overtook another vehicle and entered the lane intended for oncoming traffic.
The driver's guilt was proven by his confession and other case materials. The sanction of Part 3 of Article 596 of the Administrative Code provides for deprivation of the right to drive vehicles for six months.
However, in accordance with Article 64-1 of the Administrative Code, if the administrative offense is of minor significance, the judge may release the person from administrative liability, limiting themselves to an oral reprimand.
Considering the circumstances, namely that the driver provides full care for his mother, who is a disabled person of the first group, and that the vehicle is the only source of income, which he uses to take his mother for treatment, his financial situation, the nature and circumstances of the offense, the court deemed the offense to be of minor significance and released him from administrative liability, issuing an oral reprimand.
The proceedings were terminated under Article 742 of the Administrative Code. The court decision has entered into legal force.
