A court in the Almaty region has approved a settlement in an unjust enrichment case, with the defendant agreeing to pay 100,000 tenge monthly, reports the website infohub.kz.
The Balkhash District Court heard a claim for recovery of unjust enrichment. It was established that between January 21 and 23, 2026, unknown individuals posing as government and bank officials fraudulently obtained the plaintiff's money from his bank accounts. Abusing trust and using information systems, the money was transferred from his accounts and bank terminals to various individuals, including the defendant.
With the assistance of a conciliator judge, the parties resolved the dispute through mediation. They confirmed the completeness and accuracy of the information and signed a mediation agreement.
According to the terms of the agreement, the defendant undertook to pay the plaintiff 3.8 million tenge, including 3.5 million tenge for unjust enrichment and 300,000 tenge for legal costs, in cash monthly installments of 100,000 tenge by the 15th of each month for 38 months, starting from June 15, 2026, until July 15, 2029.
If the agreement is not fulfilled within the specified period, the writ of execution will be enforced upon the plaintiff's request. The proceedings have been terminated. The paid state duty of 34,980 tenge has been returned to the plaintiff. The ruling has entered into legal force.
