In the Zhambyl region, a man has restored his deceased mother's nationality through a court ruling. The court ordered the state corporation 'Government for Citizens' to make the necessary amendments, as reported by infohub.kz.
According to the official Telegram channel of the Zhambyl regional courts, the specialized inter-district administrative court considered a lawsuit filed by a citizen against the 'Government for Citizens' corporation regarding changes to the birth record concerning the mother's nationality.
At the time of the plaintiff's birth, his mother's nationality was recorded as 'Russian'. However, documents examined by the court confirmed that the mother's parents were of Czechoslovak and German nationality. Therefore, in accordance with the requirements of the Code 'On Marriage (Matrimony) and Family', the mother's nationality at her birth should have been recorded as 'Czech' or 'German'.
Previously, the state corporation had refused to make the corresponding changes. After the mother's death, making changes to her personal data is not permitted by law, which effectively deprived the plaintiff of the opportunity to change information about his own ethnic identity.
Given the lack of any other means to protect the violated right, and guided by the principles of justice and reasonableness, the court upheld the claim.
The court's decision obliges the defendant to make corrections to the plaintiff's birth record, changing his mother's nationality from 'Russian' to 'Czech'.
The court also noted that failure to comply with the decision within one month will result in a fine imposed on the defendant in the amount of 50 monthly calculation indices (MCI).
The decision has not yet entered into legal force.
