The Military Court of the Semey Garrison has ruled that a housing commission's decision was unlawful and ordered it to pay a serviceman monetary compensation, as reported by infohub.kz.
According to the official Telegram channel of the Military Court of the Republic of Kazakhstan, the court considered an administrative case filed by a serviceman seeking to invalidate and overturn a housing commission's protocol and to compel the payment of monetary compensation.
The court established that the man served in the military investigation department of the State Investigative Committee for the Taldykorgan Garrison from July 1996 to November 1997, and from November 1997 to July 1999 in the military investigative bodies of the Ministry of Internal Affairs of the Republic of Kazakhstan. In April 2026, he filed a report requesting monetary compensation.
The housing commission's protocol decision denied the plaintiff compensation, citing that service in the State Investigative Committee and the military investigative units of the Ministry of Internal Affairs constitutes law enforcement service and does not fall under the Armed Forces of the Republic of Kazakhstan.
According to paragraph 20 of Article 1 of the Law of the Republic of Kazakhstan "On Military Service and the Status of Military Personnel," military personnel are citizens of the Republic of Kazakhstan serving in the Armed Forces, other troops, and military formations.
Under subparagraph 15 of Article 1 of the Law of the Republic of Kazakhstan "On Defense and the Armed Forces of the Republic of Kazakhstan," other troops and military formations include the Border Service, the Aviation Service, the Border Academy, military counterintelligence and military police bodies of the National Security Committee of the Republic of Kazakhstan, and other units of national security bodies as determined by law, special purpose forces of the State Security Service of the Republic of Kazakhstan, the National Guard of the Republic of Kazakhstan, military investigative bodies of the Ministry of Internal Affairs of the Republic of Kazakhstan, management bodies and military units of civil defense of the authorized body in the field of civil protection, and military prosecutor's offices.
The court interpreted this legal provision to mean that military investigative bodies of the Ministry of Internal Affairs are included in other troops and military formations. The court upheld the serviceman's claims, declared the housing commission's decision unlawful, and ordered the defendant to pay the plaintiff monetary compensation.
The decision has not yet entered into legal force.
