A Kazakh citizen who worked as a train driver has been sentenced to prison in Russia for organizing the illegal entry of a foreigner across the border using his official position and a uniform, infohub.kz reports.

According to the press service of the Omsk Region courts in Russia, a verdict was handed down in a criminal case against a 43-year-old citizen of the Republic of Kazakhstan. He was found guilty of a crime under the Russian Criminal Code: "Organizing the illegal entry into the Russian Federation of foreign citizens, committed by a group of persons by prior conspiracy."

"The court established that the defendant P.E., who held the position of a locomotive crew driver at Russian Railways OJSC, entered into a criminal conspiracy with other persons (the criminal case against them was separated into separate proceedings) to organize the illegal crossing of the state border by a foreign citizen. For their actions, the defendant and unidentified persons received 100,000 rubles," the statement said.

According to the court, using his official position, P.E. ensured the admission of a foreign citizen into a freight train, whose entry into the territory of the Russian Federation was officially prohibited.

"The defendant gave the violator the uniform of a train crew worker, which allowed him to conceal from border control the fact of his presence on the train. In March 2023, in the Isilkul district of the Omsk region, a foreign citizen illegally crossed the Russian-Kazakh border disguised as a member of the train crew," the court statement said.

Taking into account the pre-trial cooperation agreement, full admission of guilt and active assistance to the investigation in exposing other participants in the criminal scheme, the court sentenced the convicted person to 2 years and 5 months of imprisonment to be served in a general regime correctional colony.

The verdict has not entered into legal force. The court explained to the parties the deadlines and procedure for appealing the judicial act.
