In Karaganda, a court ruled that the refusal to award a veteran athlete the title of "Master of Sports of International Class of the Republic of Kazakhstan" was unlawful, as reported by infohub.kz.
According to the official Telegram channel of the Karaganda Regional Courts, the court reviewed an administrative lawsuit filed by the veteran athlete against the State Institution "Committee for Sports and Physical Culture of the Ministry of Tourism and Sports of the Republic of Kazakhstan" seeking to declare the refusal to award the sports title unlawful and to compel the issuance of a favorable administrative act granting the title.
The lawsuit argued that the law does not prohibit or restrict awarding the title "Master of Sports of International Class of the Republic of Kazakhstan" to veteran athletes who have represented Kazakhstan in international competitions and won prizes.
The defendant requested the court to dismiss the claim, stating that the basis for awarding the title is a result at the World Championship among adults. Therefore, participation in the World Veterans Championship and winning a prize there does not meet the stated requirement.
The court ruled in favor of the plaintiff, overturning the contested decision and ordering the defendant to issue a favorable administrative act granting the plaintiff the title "Master of Sports of International Class of the Republic of Kazakhstan" within one month of the court's decision taking effect.
The court established that the legislation does not exclude veteran athletes from the category of "adults" and does not prohibit awarding sports titles to veteran athletes representing the Republic of Kazakhstan in international competitions.
The appellate court for administrative cases of the Karaganda Regional Court upheld the first-instance decision.
