In the Zhambyl region, court mediation helped resolve a dispute over survivor's benefits that arose 37 years ago, reports the website infohub.kz.
According to the official Telegram channel of the Zhambyl regional courts, the Baizak district court considered an administrative case filed by a woman against the Department of the Committee for Regulation and Control in the Sphere of Social Protection of the Population. The plaintiff's mother died in 1989, and the plaintiff herself has been a group II disabled person since childhood. Until her mother's death, she was dependent on her, as she was unable to earn a living on her own.
The woman applied to the department for survivor's benefits, but her request was denied. The respondent explained that it was first necessary to establish the fact of dependency on her mother. Disagreeing with the refusal, the plaintiff filed a lawsuit in court.
During conciliation procedures conducted by the court, the parties reached an agreement to settle the dispute through mediation. Under the terms of the agreement, the plaintiff undertook to reapply to the department for benefits, and the respondent agreed to properly consider the application and make an optimal decision. In connection with the agreement, the plaintiff withdrew her claims, and the court approved the mediation terms and returned the administrative lawsuit. In addition, the state fee was refunded to the plaintiff. The ruling has entered into legal force.
