Starting August 25, 2026, Kazakhstan will introduce a new procedure for transferring alimony payments. Funds collected under writs of execution will be credited exclusively to special bank accounts, reports infohub.kz.

The changes are stipulated by Law No. 325-VIII of June 24, 2026, which amends legislation on enforcement proceedings. The document adds a new Article 102-1.

Under the new rules, alimony recipients must open a special bank account and provide its details to the bailiff. Only such an account will receive the collected funds.

The Ministry of Justice explained that the main goal of the innovation is to protect money intended for the maintenance of children and incapacitated persons. Funds in a special alimony account cannot be seized. This ensures that alimony will be used solely for its intended purpose and will not be affected by the recipient's other debts.

To open a special account, the alimony recipient must provide the bank with an identity document, an application specifying the purpose of the account, and a copy of the court decision on alimony recovery or a notarized agreement on their payment. The bank will mark such an account as special, indicating the purpose of payments.

The absence of a special account does not relieve the payer of the obligation to pay alimony. However, until the claimant opens an account and provides its details, transferring the collected funds will be impossible.

In this case, the bailiff is obliged to notify the recipient of the need to open an account. After the details are provided, the funds will be transferred in the established order, and alimony arrears will continue to be recorded and will not be written off.

According to the Ministry of Justice, the new norms should strengthen the protection of alimony recipients, increase the efficiency of enforcement proceedings, and ensure the safety of funds intended for the maintenance of children and incapacitated citizens.
