Two administrative arrests of 10 days each have been overturned in the North Kazakhstan Region in the case of a woman raising two minor children, the website infohub.kz reports.

According to the regional prosecutor's office, two rulings had been issued against the woman holding her administratively liable. The first was for violating a protective order (Part 1 of Article 461 of the Code of Administrative Offences of the Republic of Kazakhstan), with a 10-day arrest imposed. The second was for failing to comply with special requirements (Part 2 of Article 669 of the Code of Administrative Offences), also with a 10-day arrest.

The protective order had barred the woman from engaging in conflicts with her mother and from using obscene language toward her. She was also subject to special behavioural requirements, including a ban on drinking alcohol. She failed to comply with these restrictions.

While reviewing the court rulings, prosecutors established that the woman is the mother of two minor children under the age of 14. This circumstance is grounds for overturning the arrests imposed on her.

Current legislation sets out a category of persons to whom administrative arrest does not apply. Under Part 2 of Article 50 of the Code of Administrative Offences of the Republic of Kazakhstan, this measure cannot be applied, among others, to women with children under the age of 14.

Following the prosecutor's appeals, the arrests were replaced with an administrative fine.
