A cassation court has closed the case of the deliberate arson of grain warehouses, which broke out over a personal conflict between a manager and the head of a farming enterprise in the North Kazakhstan Region. The fire caused damage worth 495 million tenge, the website infohub.kz reports.
According to the Telegram channel "Current News of Cassation Courts," the manager of the farming enterprise, harboring personal animosity toward his boss, organized the arson of grain warehouses in the North Kazakhstan Region in May 2023 together with another person. The fire destroyed property and inflicted damage on the farming enterprise amounting to 495 million tenge.
A court of first instance found the man guilty of deliberately destroying and damaging another person's property by arson, causing especially large damage (Part 3, Clause 2 of Article 202 of the Criminal Code), and sentenced him to 6 years in prison, also ordering that the material damage be recovered. The appellate instance left that ruling unchanged.
The convicted man's lawyer filed a cassation appeal seeking to overturn the verdict and the appellate ruling, citing insufficient proof of his client's guilt.
However, the cassation court concluded that the manager's guilt in organizing the arsons was confirmed by the body of evidence examined. Among it were materials from the emergency situations authorities, protocols of the inspection of the scene, findings of fire-technical examinations that established the fact of arson, data on telephone connections of the guilty persons, and testimony from the victim and witnesses. The amount of damage caused was confirmed by a judicial construction and economic expert examination.
The court deemed the imposed punishment consistent with the gravity of the crime committed and the requirements of the law. Accordingly, no grounds were found to overturn or amend the judicial acts already issued.
