A court in the Almaty Region has ordered the expulsion of a foreign citizen from Kazakhstan for violating migration legislation, despite the offender's request to be fined instead, the website infohub.kz reports.
According to the official Telegram channel of the Almaty Region courts, Court No. 2 of the Yenbekshikazakh District heard an administrative case against a foreign citizen for violating the Republic of Kazakhstan's legislation on population migration (Part 4 of Article 517 of the Code of Administrative Offences of the Republic of Kazakhstan).
It was established that on 23 September 2026, at around 19:00, during operational and preventive measures in the village of Shelek, a foreigner was identified who had arrived in Kazakhstan on 19 March 2026 to find work and had failed to leave after the period established by law expired, overstaying by more than ten days.
At the hearing, the offender fully admitted guilt. He explained that he had not known about the need to legalise his documents in time, repented of his actions and asked the court to limit the penalty to a fine.
The sanction under this article provides for a fine of 25 monthly calculation indices or expulsion from the country.
In imposing the penalty, the court recognised his repentance as a mitigating circumstance. However, given that the offender had no permanent income, no close relatives in Kazakhstan and had remained in the country illegally for a lengthy period, the court ordered the penalty of administrative expulsion from the Republic of Kazakhstan.
The offender was given 5 days to leave voluntarily.
The court's ruling has not yet entered into legal force.
