In the West Kazakhstan Region, a court has stripped a local resident of his driver's license due to epilepsy. The regional police department filed the lawsuit, and the court ruled in its favor, according to infohub.kz.
According to the official Telegram channel of the West Kazakhstan Region courts, the Zhangaly district court reviewed the civil case brought by the police department against the man. The claims sought to terminate his right to drive vehicles and oblige him to surrender his driver's license.
During the proceedings, it was established that on August 29, 2017, the defendant obtained a driver's license for category 'B'. However, according to medical records, he is under dispensary observation with a diagnosis of G40.8 – 'Other specified forms of epilepsy'.
Under current legislation, a deterioration in a driver's health that prevents safe driving and is confirmed by a medical report serves as grounds for terminating the right to drive. The court found that the defendant's condition is included in the list of medical contraindications and is an absolute contraindication to driving a car.
Considering all the circumstances, the court granted the lawsuit. The driver's license is revoked, and the man is required to surrender it to the West Kazakhstan Region police department. The court decision has not yet entered into legal force.
