Kazakhstan has amended the rules on the transfer of gifts to civil servants and their accounting on the balance sheet — the corresponding government decree has been published electronically on the website of the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan, infohub.kz reports.

The new document addresses the accounting, storage, valuation and further use of property that has become state property. In particular, it concerns gifts that officials and their family members receive at protocol and other official events.

According to the decree, for the gratuitous receipt of a gift transferred or presented to a person and/or their family members during a protocol or other official event, the authorized body provides an opinion on the need to transfer the property to the balance sheet of a state legal entity. The opinion is to be provided within no more than 10 working days from the day the person transfers the gift to the authorized body during a protocol or other official event, the statement says.

Furthermore, the person who transferred the gift to the authorized body has the right, with notification of a superior official, to buy it back under a sale and purchase agreement concluded with the authorized body. The gift may be bought back at the value specified in the document "On Valuation Activities in the Republic of Kazakhstan".

"The buyback of the gift is carried out under a sale and purchase agreement between the authorized body and the person who handed over the gift, within 7 calendar days from the day the authorized body receives notification from the person who received the gift," the document states.

The transfer of the handed-over gift is carried out by signing an acceptance certificate between the authorized body and the person who handed over the gift.
