Officers of Kazakhstan's National Security Committee detained a foreign national who had left his military post in the Russian Armed Forces without authorization and illegally crossed the republic's state border. The man appeared in court and was expelled from the country, infohub.kz reports.
According to the press service of the West Kazakhstan Regional Court, the Bokeikhan District Court heard a criminal case against a defendant charged under Part 1 of Article 392 of the Criminal Code of the Republic of Kazakhstan.
The court established that the defendant, a citizen of a foreign state, had served in the Russian Armed Forces. In July 2025, he left his place of service without authorization and went into hiding from the competent authorities of the Russian Federation.
In May 2026, seeking to leave Russia, he studied the terrain using mapping services and mapped out a route to illegally cross the Russian state border toward Kazakhstan.
To carry out his intent to illegally cross the state border, the defendant, aware of the public danger of his actions and ignoring the fences and border markers installed by the Russian Federation and the Republic of Kazakhstan, illegally crossed the state border of the Republic of Kazakhstan outside an established checkpoint and without undergoing border or other types of control.
After crossing the state border, the man headed for a highway in order to reach Uralsk. From Uralsk he then traveled to Taraz, from where he intended to reach a foreign country, but was detained by officers of Kazakhstan's National Security Committee.
At the court hearing, the defendant fully admitted his guilt and asked the court to take into account that he had been forced to act as he did. He also asked not to be deprived of his liberty, not to be expelled from Kazakhstan, and to have the Amnesty Law applied to him.
The court found the defendant guilty and sentenced him to a fine of 865,000 tenge, with expulsion from the Republic of Kazakhstan and a ban on entering the country for 5 years.
At the same time, the court, under Paragraph 1 of Part 1 of Article 1 of the Amnesty Law, released the foreigner from the main penalty of a fine.
The court ruling has entered into force.
