A Kostanay city court has ruled in favor of a car owner, ordering the construction department of the Kostanay akimat to pay compensation for vehicle damage caused by hitting an open manhole, infohub.kz reports.
According to the official Telegram channel of the Kostanay region courts, a civil case was heard on a claim by a car owner for material damages resulting from a traffic accident.
The court found that in October last year, the driver of a Chevrolet owned by the plaintiff struck an open manhole on the roadway in the Bereke microdistrict. The vehicle sustained mechanical damage as a result.
The defendant had previously been held administratively liable for violating manhole maintenance rules, which led to the traffic accident and vehicle damage.
During the trial, the defendant's representative objected to the claim, arguing that construction work at the site had not been completed and that the contractor should be responsible for safety. However, the court established that the manhole was under the defendant's responsibility, and no evidence was presented to refute its guilt.
The court ruled in favor of the plaintiff, awarding 205,400 tenge in material damages and 85,000 tenge for assessment costs.
