A specialized inter-district administrative court in Kostanay Region has dismissed a claim by an individual entrepreneur seeking to overturn a special investigation report into an industrial accident and the conclusion of a state labor inspector, infohub.kz reports.
According to the official Telegram channel of Kostanay Region courts, the case stemmed from an incident on April 15, 2026, at the entrepreneur's fish processing workshop in Kostanay. A female worker suffered a severe industrial injury: crushing of the right hand and forearm, extensive damage to the skin and subcutaneous fat up to the shoulder joint, and first-degree traumatic shock.
From the victim's testimony, it was established that she had worked for the entrepreneur for about a year. However, the court found that no employment contract or civil-law service agreement had been concluded between the employer and the woman, in violation of Article 33, Paragraph 3 of the Labor Code.
In addition, the worker had not received safety and labor protection briefings or been tested on safety and labor protection requirements.
According to the special investigation report and the state labor inspector's conclusion, the employer is fully at fault in the accident — 100%, with no fault attributed to the employee — 0%.
After thoroughly examining the administrative case materials, the court concluded that the employee's actions did not constitute gross negligence, as the established circumstances indicated that the employer had violated labor legislation regarding the formalization of employment relations and the provision of safety and labor protection.
Based on the foregoing, agreeing with the respondent's conclusions on the degree of fault of the employee and employer, the court ruled to dismiss the individual entrepreneur's claim. The court decision has not yet entered into legal force.
