A court in Kostanay has sentenced a heavy equipment operator to prison for fatally running over a pedestrian during roadwork, the website infohub.kz reports.
As Alau previously reported, the tragedy occurred on April 27 on Kievskaya Street. A criminal case was opened into the incident.
According to the publication, the incident happened during work to level the edge of the roadway. According to the prosecution, the 36-year-old forklift driver, while reversing, failed to ensure the maneuver was safe and struck an 82-year-old man. The pedestrian died at the scene from his injuries.
It is noted that after the collision, the driver called an ambulance and police himself, and during the investigation assisted in establishing the circumstances of the incident. He fully admitted guilt for violating traffic rules that negligently caused a person's death.
The court considered the defendant's remorse and the fact that he has minor children as mitigating circumstances. No aggravating circumstances were established. The victim's side agreed with the punishment proposed by the state prosecutor.
As a result, the heavy equipment driver was sentenced to 2.5 years in a minimum-security penal institution.
The sentence has not yet entered into legal force.
