A woman in Kostanay ordered custom furniture for nearly one million tenge with a 25-day production period, paid a deposit, but the order was never fulfilled — the dispute ended with a mediation agreement in court, infohub.kz reports.

According to the official Telegram channel of the courts of Kostanay Region, the Kostanay City Court heard a civil case on a woman's claim against an individual entrepreneur for termination of a contract, recovery of funds, penalties, and compensation for moral damages.

The court established that the parties had concluded a contract for the manufacture of custom furniture. Under the terms of the contract, the order value was 955,000 tenge, and the production period was 25 days.

In fulfillment of the contract terms, the plaintiff paid 684,000 tenge. However, the defendant failed to fulfill the obligations to manufacture and deliver the item within the established period.

The plaintiff repeatedly demanded that the defendant fulfill the contractual obligations or return the money. The defendant subsequently made a partial refund of 400,000 tenge. The remaining debt amounted to 284,000 tenge.

Due to improper performance of contractual obligations, the plaintiff filed a lawsuit, also seeking penalties and compensation for moral damages.

During the proceedings, the parties reached an agreement to settle the dispute through mediation.

Under the agreement approved by the court, the plaintiff waived her claims on the condition that the defendant fulfills the reached agreements.

The defendant undertook to pay the plaintiff more than 434,000 tenge, including the debt amount and legal representation costs.

In case of untimely fulfillment of obligations, the agreement provides for the possibility of forced recovery of the debt, as well as penalties of more than 42,000 tenge and compensation for moral damages of 150,000 tenge. In such a case, the total amount of obligations would exceed 627,000 tenge.

The court, having reviewed the terms of the agreement, concluded that it does not contradict legal requirements and does not violate the rights and legitimate interests of the parties.

The mediation agreement was approved by the court, and the civil case proceedings were terminated.
