A resident of Kostanay won a court ruling for compensation after ice falling from a building roof damaged his car. The vehicle owner was awarded 2 million tenge, reports infohub.kz.

According to the official Telegram channel of the Kostanay region courts, the Kostanay city court heard a civil case seeking damages for harm caused by ice falling from a building roof.

The court found that in March 2026, a mass of snow and ice fell from the roof of a building on Abaya Avenue in Kostanay onto the plaintiff's parked car, causing mechanical damage. The extent of the damage was confirmed by independent appraisals: repair costs exceeded 1.8 million tenge, and loss of market value amounted to 180,000 tenge.

The defendant, an individual entrepreneur, disputed the claim, citing warning notices about possible snow and ice fall. However, the court determined that provided photographs could not show when they were taken or posted. Video footage taken immediately after the incident confirmed the absence of any warning signs or notices.

In its ruling, the court relied on Articles 9 and 917 of the Civil Code, as well as the Rules for Improving Towns and Settlements of the Kostanay Region, which require building owners to timely clear roofs of snow and ice and ensure the safety of citizens and their property.

The court concluded that the defendant had not taken all necessary measures to prevent the damage and granted the claim. The ruling orders the individual entrepreneur to pay the plaintiff 2 million tenge in damages. The decision has not yet entered into legal force.
