A woman in Kazakhstan's Kostanay Region who was publicly declared the winner of a contest whose grand prize was an apartment but never received it has won monetary compensation through court. The Mendykara District Court upheld her claim and ordered a limited liability partnership to pay more than 7.6 million tenge, according to infohub.kz.
According to the official Telegram channel of the Kostanay Region courts, the Mendykara District Court heard a civil case brought by a female citizen against the LLP seeking either the transfer of the contest's grand prize or the recovery of its monetary value.
During the proceedings, the court established that in July 2025 the LLP announced an Instagram contest with an apartment as the grand prize. In October 2025, the plaintiff was publicly declared the winner. The fact that she was declared the winner was confirmed by screenshots of Instagram posts and was not disputed by the defendant.
Objecting to the claim, representatives of the LLP argued that the plaintiff's account was fake, and that the contest results had therefore been annulled and a new drawing held, as a result of which the prize was given to another participant.
The plaintiff and her representative disagreed with the defendant's arguments, stating that the account was personal and had been created long before the contest. They noted that the defendant had not provided evidence reliably confirming that the account was fake.
Under Part 1 of Article 911 of the Civil Code, any person who has publicly announced the payment of a reward in monetary or other form for the best performance of work or the achievement of other results must fulfill the obligation to the person who, in accordance with the contest's terms, is recognized as its winner.
During the proceedings, it was established that no IP address checks were conducted, that the accounts were not determined to belong to one person, and that no technical means of verifying the social media page were used. Thus, the defendant's arguments that the plaintiff's account was fictitious were not sufficiently supported by the evidence presented to the court.
Taking into account the established circumstances of the case, the assessment of the evidence presented, and the principles of fairness and reasonableness, the court concluded that the claim should be granted.
By the court's decision, the LLP was ordered to pay the woman 7,682,000 tenge. The court's decision has entered into legal force.
