A court in Kostanay has recognized an employment relationship between a man and a company despite the absence of a formal contract, ordering the firm to pay 3 million tenge in compensation for a severe workplace injury. The case was reported on the website infohub.kz, citing NUR.KZ.
According to the official Telegram channel of Kostanay region courts, the Kostanay City Court heard a civil suit brought by the man against an LLC, seeking recognition of the employment relationship, compensation for moral damages, and lost earnings.
The court found that the plaintiff had been working as a miller at the defendant's production facility since February 2026 without a written employment contract. On March 30, 2026, while performing his duties, he suffered a traumatic amputation of several fingers on his left hand.
During the trial, the existence of an employment relationship was confirmed by a set of evidence: witness testimony, notarized messenger correspondence, records of money transfers, cellular operator data showing the plaintiff's location during working hours, and information from the tax department indicating the defendant was actively operating its business.
Assessing the evidence, the court concluded that the plaintiff was effectively allowed to work with the employer's knowledge, thereby creating an employment relationship.
By its decision, the court established that the plaintiff had been employed as a miller by the LLC from February 1 to March 31, 2026.
In addition, the court ordered the defendant to pay 3 million tenge in moral damages. The claim for lost earnings was dismissed as premature, since the required workplace accident investigation had not been conducted and no official report had been issued to determine the degree of lost professional capacity.
The court’s decision has not yet entered into force.
