The family of 21-year-old Nurai Serikbai, who was killed in Shymkent, has explained why they demanded 10 billion tenge in moral damages from the defendant Sherkhan Aymakhan... reports infohub.kz.
The girl's brother, Sultan Serikbai, said the family wants to achieve not only criminal but also financial accountability. According to him, the size of the claim should be such that the convicted person cannot simply pay compensation and forget about his obligations to the victims.
"From a legal standpoint, the convicted party should not have any opportunity to avoid paying these funds and benefit from parole, sentence reduction, or other ways of easing punishment without compensating for the harm caused. Therefore, the amount must be so significant that it would be impossible to simply pay and forget. So that the person, figuratively speaking, would be paying it for the rest of his life," Sultan Serikbai said on Instagram.
Serikbai stressed that the claimed 10 billion tenge is not an assessment of the value of his sister's life. According to him, no amount of money can compensate the family for their loss.
"The law stipulates that the injured party itself determines the amount of moral compensation to demand. So we have indicated the amount we consider fair and justified. From a moral point of view, even if all the money in the world were collected and given to us, it could never compensate us for the loss of Nurai. Because for us, the price of a human life is not measured in money," he said.
The brother of the deceased added that if the family manages to secure the compensation, they intend to use the funds to help girls who have faced stalking or other forms of violence.
"If we are destined to live with the pain of losing Nurai for the rest of our lives, then we believe that the accused party should also bear their punishment and responsibility, including financial," Serikbai noted.
Earlier, Kursiv reported that the inter-district court in Shymkent is continuing the trial in the murder case of 21-year-old Nurai Serikbai. Previously, the family's lawyer, Ayanhan Omarov, announced the claims against Sherkhan Aymakhan.
The documented material damage was estimated by the family at 14 million 739 thousand tenge. This amount includes funeral expenses, religious rites, 40-day memorial, gravestone installation, and trips for investigative actions and court hearings.
Separately, the injured party demanded 10 billion tenge in moral damages from the defendant.
