A resident of Aktobe, who was acquitted in a case involving the embezzlement of funds from a company, demanded 15 million tenge in moral damages from the state, but will receive significantly less — 1.5 million tenge. In 2023, two managers of the enterprise and their accomplices were sentenced to long prison terms. The woman, who was also implicated in the case, was fully acquitted for lack of a criminal offense.
After her acquittal, she filed a lawsuit against the Ministry of Finance, demanding 15 million tenge for moral suffering caused by unlawful criminal prosecution. The plaintiff explained that she was in a severe depressive state for nearly three years due to the criminal case and could not lead a normal life.
The court partially granted her claim. According to the ruling, the Ministry of Finance will pay her 1.5 million tenge in moral damages, ten times less than the amount sought. The state will also reimburse 5.5 million tenge spent on legal services.
