A court in Oral has refused to transfer to a woman the lease of a state housing fund apartment previously granted to her father, because she did not live with him, the website infohub.kz reports.
According to the press service of the West Kazakhstan Regional Court, Court No. 2 in Oral heard a civil case brought by the woman seeking to have the lease for the state-owned housing previously granted to her father registered in her name.
The court found that the plaintiff's father had been granted an apartment from the state housing fund under a lease agreement. After his death in 2025, the authorized body terminated the lease.
The plaintiff, considering herself the heir of the deceased, asked for the apartment lease to be registered in her name. She was refused, however, because she had not lived with her father on a permanent basis.
During the proceedings, the court established that the plaintiff's parents had previously divorced, that the plaintiff herself had not lived with her father, and that she was not listed as a member of the tenant's family in the lease agreement.
The court explained that the right to use state housing fund premises does not pass automatically by inheritance. In cases provided for by law, that right may be retained by members of the tenant's family who lived with him permanently in the premises.
Given the established circumstances, the court dismissed the claim to have the state housing lease registered in the plaintiff's name. The court's decision has entered into legal force.
