A court in Petropavlovsk has upheld a woman's right to a full pension calculation, establishing that mandatory pension contributions were paid on a monthly basis over several years, the website infohub.kz reports.

According to the official Telegram channel of the courts of the North Kazakhstan Region, Court No. 2 in Petropavlovsk heard a civil case to establish the fact that mandatory pension contributions had been paid.

The applicant had reached retirement age, but when her pension was awarded, the period of her participation in the funded pension system was not fully taken into account.

During the proceedings, it was established that the woman had worked for an individual entrepreneur between February 2008 and December 2024. Records from the Unified Accumulative Pension Fund showed that the employer had made pension contributions, but had transferred them late — once a quarter, which was permitted under the legislation in force at the time. As a result, that period was not fully counted in the calculation of her pension benefits.

The fact that pension contributions had been received into the applicant's account was confirmed by a statement from the Unified Accumulative Pension Fund. In addition, witnesses questioned at the hearing confirmed that contributions had been deducted monthly from her wages and transferred late by the employer.

Assessing the evidence as a whole, the court found that the mandatory pension contributions for the disputed period had in fact been paid, and that their late arrival had affected the recording of the applicant's period of participation in the funded pension system.

The court granted the application and established the fact that mandatory pension contributions had been paid on a monthly basis between 1 February 2008 and 31 December 2014.

The court's decision has entered into force.
