A driver in Semey has successfully challenged a patrol police fine for improper parking, with a specialized interdistrict administrative offenses court ruling in the motorist's favor and terminating the proceedings, infohub.kz reports.
According to the official Telegram channel of the Abai Region courts, the man filed a complaint against a patrol police order holding him administratively liable under Part 1 of Article 597 of the Code of the Republic of Kazakhstan on Administrative Offenses, which provides penalties for violating rules on stopping or parking vehicles.
In his complaint, the driver stated he disagreed with the ruling, explaining that he considered the fine for parking near an apartment entrance unfounded.
During the court hearing, it emerged that the case materials contained no evidence confirming the vehicle had been stopped in violation of established rules, nor did they specify the location of the alleged offense.
After hearing the arguments of both parties, the court concluded that, absent properly collected evidence, the assumptions of police officers could not serve as the basis for a court decision finding the driver had committed an administrative offense.
Guided by the principle of the presumption of innocence, the specialized interdistrict administrative offenses court of Semey terminated the administrative offense proceedings.
