A Shymkent interdistrict criminal court has acquitted a woman accused of large-scale fraud, the website infohub.kz reports.
According to the official Telegram channel of Shymkent courts, the case was heard under Part 3, Article 190, Clause 1 of the Criminal Code — large-scale fraud.
According to the prosecution, on August 16, 2025, the defendant promised the victim assistance in obtaining business visas to South Korea for her and her sisters and allegedly fraudulently took 12 million tenge from the victim.
The prosecutor sought a prison sentence for the defendant. The victim insisted on a strict punishment. The defendant pleaded not guilty and asked to be acquitted.
The court found that the prosecution's case rested on the victim's testimony, a receipt, a video recording and a psychological and linguistic expert report. However, during the trial the prosecution's evidence was refuted.
Experts were given only a clipped 15-second recording, and the video did not capture the handover or receipt of the 12 million tenge, the writing of the receipt, or any prior agreements on visas. In the parties' phone messages between July and August 2025, there is no mention of Korea or visas at all. At the same time, the records show numerous calls and threats from the victim demanding the return of money for gold items.
Neither the victim nor her sisters gave the defendant any documents for a visa. The victim's sisters had never seen the defendant and had never discussed visa arrangements with her.
The court concluded that the parties had a civil-law relationship tied to a debt for gold items purchased earlier, and that the defendant did not receive the 12 million tenge.
In the absence of a criminal offense in her actions, the woman was found innocent and acquitted. The verdict has entered into force.
