In Shymkent, an alimony debtor challenged in court the rulings of a private bailiff who had calculated his debt at more than 14 million tenge. The claim was only partially granted, reports infohub.kz.

According to the official Telegram channel of Shymkent courts, the city's specialized interdistrict administrative court heard an administrative case on the debtor's claim against a private bailiff to challenge the issued rulings.

During the proceedings, the court found that the private bailiff had issued a ruling determining alimony debt in the amount of over 14 million tenge. In addition, he applied interim measures: seizing the debtor's movable and immovable property, and issuing rulings to impound vehicles and restrict travel outside the Republic of Kazakhstan.

The plaintiff disagreed with the debt calculation, stating that the private bailiff had failed to take into account his actual income and pension contributions for the disputed period. On this basis, he sought to have all issued rulings annulled.

After reviewing the case materials and information on pension contributions, the court concluded that the debt amount had been calculated incorrectly—without considering the debtor's actual income. To restore the plaintiff's rights and legitimate interests, a recalculation of the debt was required. Accordingly, the ruling determining the debt was recognized as unlawful and annulled.

The court denied the claims to lift the property seizures, vehicle impoundment, and travel restrictions. As the court explained, the existence of alimony debt was confirmed, and the interim measures taken by the private bailiff were aimed at enforcing the judicial act.

Ultimately, the court partially granted the claim. The decision has entered into legal force.
