Prosecutors in Shymkent have secured the actual enforcement of a Constitutional Court ruling concerning the collection of fees for private bailiffs' services, infohub.kz reports.
According to the supervisory authority's official website, practical enforcement of the Constitutional Court's regulatory ruling No. 86-NP dated June 11, 2026, has been ensured.
"Previously, when enforcing court decisions on determining child visitation arrangements, private bailiff service fees were collected from both parties, including the parent in whose favor the court decision was issued. The Constitutional Court stated that such an approach is unacceptable, since enforcement of a court decision is part of the right to judicial protection and should not create additional obstacles for the claimant," the agency said.
An analysis conducted by the Shymkent prosecutor's office established that after the ruling entered into force, three private bailiffs continued illegally collecting fees from claimants.
Based on prosecutorial oversight acts, citizens' rights have been restored, and the illegally collected funds have been fully returned.
