A court in Shymkent has upheld a complaint from a 36-year-old teacher suspected of committing sexual acts against a seven-year-old student at a private school, infohub.kz reports.

The case concerns a digital literacy instructor suspected of committing sexual acts against a first-grade girl. The court granted the man's complaint against the reclassification of the charge.

The incident occurred in February. According to the mother of the seven-year-old girl, her daughter complained of body pain and described the teacher's actions. The 36-year-old man was later detained.

Initially, the case reached court under the article on sexual harassment of persons under the age of 16, which carries a maximum penalty of only corrective and community service, as well as arrest for up to 50 days.

However, the court sent the case for review under Article 124 — "Molestation of persons under the age of sixteen." Unlike Article 121, this article provides for actual imprisonment.

But the suspect disagreed with the reclassification and filed a complaint. The court upheld it today.
