A student from Pavlodar who studied on a state grant to become a teacher repaid the cost of her education, but the court exempted her from paying a penalty, reports infohub.kz.
The case was heard in the appellate instance of the Pavlodar regional court on a claim by JSC Financial Center against citizen T. The girl received a diploma in pedagogy, having signed an obligation to work for at least three years. After graduation, she was referred to the Employment Center, but did not fulfill her obligation.
As a result, she was ordered to pay the training costs of 1,773,200 tenge, but the court denied the claim for a penalty. The judicial panel considered the demand for reimbursement of costs lawful, since the obligation to work had not been fulfilled and no grounds for exemption were established. At the same time, the refusal to impose a penalty was deemed justified, as neither the contract nor the legislation provides for such an obligation.
