The Taraz City Court has rejected a financial center's claim to recover tuition costs from a university graduate under a state grant, after the defendant was diagnosed with a severe mental illness that prevents him from performing the professional duties of a teacher, infohub.kz reports.
According to the official Telegram channel of the courts of Zhambyl Region, the Taraz City Court heard a civil case brought by a financial center against the defendant seeking recovery of tuition costs.
In 2016, the defendant was enrolled under an educational grant at Kazakh Academy of Sport and Tourism JSC, majoring in physical education and sport. During his studies, 1.7 million tenge was transferred from the national budget to the university's account. In 2020, the defendant successfully graduated.
Under the terms of the contract, the defendant was required to work for at least 3 years in educational organizations. The plaintiff filed a lawsuit demanding recovery of 1.4 million tenge in tuition costs and 1.1 million tenge in penalties, noting that the defendant had worked for only 7 months.
The court established that after graduating, the defendant was diagnosed with a severe mental illness. He underwent treatment repeatedly and was registered with a psychiatric dispensary.
The court concluded that the defendant cannot be held responsible for the onset of the illness, which prevents him from performing the professional duties of a teacher.
The court ruled to dismiss the financial center's claim in full. The ruling has not yet entered into legal force.
