A private bailiff in Taraz embezzled part of the money received from debtors and used it for personal purposes, causing over 1 million tenge in total damage to three victims, reports infohub.kz.
According to Court No. 2 of Taraz, the bailiff withheld part of the funds intended for claimants in several episodes. His guilt was confirmed by testimony from victims and witnesses, physical evidence, and other case materials. During the trial, the man fully admitted his guilt, stated that he had compensated the damage, and requested a lighter sentence. The victims, having received compensation, did not insist on a strict punishment.
The prosecutor asked for two years of restriction of liberty under the amnesty law. The court found the defendant, identified as S., guilty under Part 2 of Article 251 of the Criminal Code and sentenced him to two years of restriction of liberty. Applying the amnesty law, the court released him from serving the main sentence, the court said. The court took into account his admission of guilt, full compensation of damages, and the presence of minor children. No aggravating circumstances were found. The sentence has entered into force.
Earlier, it was reported that Kazakhstan tightened control over the activities of private bailiffs. Mandatory certification was introduced, and justice authorities and chambers of private bailiffs were granted the right to request bank statements during inspections. Failure to pass certification may result in license revocation.
