A specialized inter-district administrative court in West Kazakhstan Region has reviewed the legality of the sale of a mortgaged car that was sold at an electronic auction for nearly half its market value, infohub.kz reports.
According to the press service of the West Kazakhstan Regional Court, the case was brought by a woman challenging the actions of a private bailiff in selling her 2012 Range Rover Sport.
The plaintiff said the vehicle, which was pledged to a bank, had been sold without the court order required by law for foreclosure on mortgaged property. She also noted that the debtors owned other property that was not encumbered by a pledge.
The court established that the car was sold at the electronic auction for 6,680,850 tenge against a market value of 12,147,000 tenge. In addition, the private bailiff failed to follow the procedure established by law for foreclosing on mortgaged property.
Following its review, the court ruled unlawful and annulled the October 1, 2025 order to foreclose on the car, the December 15, 2025 order transferring it for sale, and the January 15, 2026 protocol on the results of the electronic auction.
"The court's decision is aimed at ensuring the legality of enforcement proceedings and protecting the rights of parties to legal relations when foreclosing on property encumbered by a pledge," the court said.
